McCanns silence the Book


In today's Daily Express there is a very small article that reports the McCanns successful application for an Injunction to have the Book "The Truth of the Lies" removed from the Bookshelves of European retailers. This is the book written by Gonzales Amaral, the Senior Detective initially acting for the Portuguese Police in the case of the missing Madeleine McCann. A TV Documentary suffered the same fate.

330,000 copies have been sold and considering that it is only available in Portuguese it has proved very popular. (We have a copy in Portuguese if anyone wants to have a shuftie.)

The McCanns are reported as saying, "Mr Amaral's central thesis has no evidence whatsoever to support it." Excusing the bad grammar, we wonder how the expertise of a Senior Detective and his team can be less reliable than that of two professional adults who chose to leave their three very young children unattended whilst they went out on an evening of drink and food.

The Mccanns it seems, are trying to silence anyone who doubts their version of events on the 3rd May.Maybe, we would have been a little more inclined to believe them if they had not kept changing their story and timelines.

Mr.Amaral has now written another book "The English Gag" it contains the mystery of the Pink Blanket...now you see it now you don't. The first ever article was TimesonLine whereby Jane Tanner said " She saw what looked like a child wrapped in a Pink Blanket"...She later denied she mentioned a blanket. Amaral takes to task what exactly happened to Madeleine Mccanns Pink Blanket and why Tanner went back on her word.
It must be important to the Mccanns story,as they now want this book also banned...

In Portimão, 20 miles up the coast from Praia da Luz, Sofia spoke of the anguish suffered by her husband, who coordinated the McCann investigation. The McCanns are suing him for £1million they believe he has made with his book about the case, The Truth Of The Lie, and a documentary.

They are particularly angered over his claims that Madeleine is not alive. Civil servant Sofia says her 49-year-old husband suffered post traumatic stress after he was removed as head of the Madeleine investigation in September 2007. He took early retirement the following month, even though he lost two-thirds of his pension.

“It was a bad time for Gonçalo,” said Sofia. Even in his sleep he was going over in his mind what had happened to him and how his career was brought to a premature end.

“I heard him talking in the night ­because of nightmares. Everything he did, every action he took was going through his head.

“I was worried ­because he is such a calm, tender man but luckily over the past few months the nightmares have stopped.” Sofia, who works in the Portimão mayor’s office and is responsible for three major projects, including a new Algarve airport, speaks English fluently and is both amused and angered by comments aimed at her husband from some people in Britain. “We know how Gonçalo is portrayed in Britain, the caricature of a foreign detective missing the clues, but the reality is that you will not find a better detective in Portugal.

“There were many times in the investigation when his bosses said, ‘You have done enough’ but he kept working and working, chasing all the leads.

“There are satellites which probably have close-up pictures of what was happening on the ground that day. He tried to get the images but he couldn’t. The US said the satellites were trained on Morocco at the time and that was it. That is what annoys him because he says the inquiry was not completed to his satisfaction.

“Goncalo loves me and our three girls very much but he lives for his job. For him an investigation is like a mathematical equation.

“One and one has to make two. Until the answer is found he will not give up.” From the proceeds of the book her husband has bought a Jaguar car but she insists he has not made a lot of money and that he will defend the legal action.

“We are now living on one-third of our budget for the month but that is OK for us because he made the right decision,” she said.

“If he was financially motivated, he would have stayed in his job for the full pension but that is not his way.”

His 25-year-old daughter from his first marriage, also called Sofia, has just passed a law degree. His wife has a daughter Rita, 11, from her first ­marriage and she has a daughter, Agnes, with Gonçalo who will soon be six.

This week there is a double birthday celebration, Sofia’s today and her ­husband’s 50th on Friday.

“We will see all our family and friends and enjoy ourselves,” she said. “We are so lucky to have three beautiful girls in the family.

“Gonçalo is very proud of them all. He is very good with them at home but my only complaint is that he is not strict enough with them. He lets them do what they want where I have to be a little stricter.

“He never yells at them but he can also be a little overprotective. He is always worrying about them having accidents in the playground or ­wherever. I could not wish for a better father.”

The couple met 10 years ago through a friend and married in June 2000. They spent their honeymoon in the Azores, where her husband dreams of ­spending his retirement.

THE wife of Portuguese detective Gonçalo Amaral has denied they are locked in a personal battle with Kate and Gerry McCann and has spoken of their pity for the distraught couple.

“Everyone thinks we are fighting the McCanns but this is not true,” said 38-year-old Sofia Leal in an exclusive interview with the Sunday Express.

“I tell people all the time that they are having to endure the hardest pain in the world, which is losing a child.

“As a mother I cannot imagine what kind of pain that is. It is so hard.

“Like Kate McCann, I am a ­Catholic. The image of pain in the Catholic church is not Christ on the Cross but Mary holding her child in her arms. It is the pain of the loss of a child and there is no worse pain in the world. We are sorry for that.”

That pain was etched on the face of Kate McCann when she made a fleeting visit to Lisbon last week to meet her lawyers and to appeal for help in finding her daughter, snatched in May 2007 from a holiday apartment in Praia da Luz on the Algarve.

Close to tears, Kate said: ‘‘She’s six now but we’ve just got to keep going. It has been very harrowing and draining. But there is no choice, she needs us to find her and bring her home.”

Why does she say so specifically THE LAST TIME. Does she consider it as the actual LAST TIME or a possible LAST TIME?

This is also Interesting. Mccann always denied that the twins were sedated. Here ,while he is driving he does a complete turn around and now thinks that the twins maybe...were given a substance...

Was this comment made after Fiona Payne gave her statement? she found it odd that on the night of the 3rd Kate kept placing her hand in front of the twins noses to see if they were breathing...

This is a Police Statement given by one of the Friends of the Mccanns and Paynes..this statement was not given to PJ until months after their investigation started....Why?...A child was missing yet British Police chose not to hand over this information that may have been vital. Payne at this time was still in PDL., he could have been questioned by PJ...The moment was lost. Payne later refused to go back to PDL along with the rest of the group for the reconstruction. Oddly enough ,he did not go back to PDL with Mccann when he did his reconstruction...

I give this declaration in relation to the McCANN family who are currently in Portugal. The McCANN family is composed of Gerry McCANN, his wife, Kate McCANN and their three children, Madeleine, of 4 years old, and Sean and Amelie, who are twins and of 2 years of old.

As is profusely divulged in the news, Madeleine is not with her family, at present, and has been missing for the last two weeks.

I will begin by explaining that I am married to Savio Gaspar and that we have two daughters. Exxxx of almost 3 years old and Ixxxx which is now 1 year old. I have been married to Savio for 11 years. I am a general practitioner as is my husband. I met my husband when we were (page 1) working together in Exeter, around 14 years ago.

In order to explain how we know the McCANN family, I would like to state that my husband knows Kate as they both attended Dundee University between 1987 and 1992. At that time, Kate name was Kate HEALY. I met Kate and Gerry at the occasion of their wedding, in 1998, in Liverpool. Both Savio and I went to the wedding, since Savio was an old friend of Kate, we were invited to the event.

From what I know, Savio did not know Gerry before the said wedding. After this time, we met as friends, probably around three times a year, and we would go out together for the weekend. I would say that we become intimate friends of Gerry and Kate.

I remember that in 2002 or 2003, Savio and I spent a weekend with Gerry and Kate in Devon. We maintained contact with each other via telephone.

In 2002/2003 Savio and I were living in Birmingham and the McCANN’S in Leicester.

In September of 2005 Savio, myself and Exxxx, who at the time was 1 and a half years old, spent our holidays abroad, in Mallorca. We went (page 2) on holidays with Kate, Gerry, and Madeleine, who should have been around 2 and a half years old, and the twins, Sean and Amelie, who were only months old. I remember that I was pregnant with Ixxxx.

On those holidays we also met Gerry and Kate's friends.

There was a couple, whose names were Dave and Fiona, and whose surname was PAYNE, I think. I believe that they were married and had one daughter, 1 year old, named Lxxx. I remember that on these holidays, Fiona was pregnant.

There was another couple, whose names were Txxxx and Sxxxx, and whose family name I cannot remember who were also on holiday with us. They had two boys, of 1 and 3 years old, whose names I do not remember. I did not know these two families until we went on holidays together. As I recall, I think that David organised the holidays and we all stayed together in a big house while we stayed in Mallorca.

We spend a week on holidays, however, the McCANN family, and the PAYNE family stayed for two weeks. I believe that Txxxx and Sxxxx, and their two children, also stayed for one week.

Two or three days passed in Mallorca where we had fun (Page 3) with our children. Possibly around the fourth or fifth day abroad, I remember an incident that stayed recorded in my head. I say this in this way, because I have thought many times about the incident that I am about to describe.

Besides this [incident], I remember that Dave did the same thing once again. When I refer to this, I want to clarify that it was during a conversation in which he was talking about an imaginary situation, though I could not say exactly what about.

I believe that he was talking about his own daughter, Lxxx, although I cannot be certain. He put one of his fingers in his mouth and slide it in and out, and with the other hand, drew a circle around his nipple in a sexually and provocative way. I believe that he was referring to the way that Lxxx, would behave or do it.

I believe that he did this later on, during the holidays, but I cannot be sure. The last time, besides this one, when I was with Dave and Fiona was several weeks after the holidays, when Savio and I met Gerry, Kate, Dave and Fiona at a restaurant in Leicester.

I am absolute certain that he said what he said and that he repeated the same gestures that I referred, however that could have occurred in a restaurant in Leicester, though (page five) I believe that it was later on, in Mallorca. When I heard Dave doing and making this a second time, I took it more seriously.

I remember thinking whether he looked at the girls in a manner different from me or from the others. I imagined that maybe he had visited Internet sites related to small children. In short, I thought he was interested in internet child porn.

During our holidays I was more attentive at bath time after hearing Dave saying that.

During our vacation in Mallorca, it was the fathers who took care of the children baths. I had the tendency to walk close to the bathroom, if Dave was bathing his children. I remember telling Savio to be careful and to be there, in case it was Dave helping to bathe the children and, in particular, to my daughter Exxxx. I was very clear about this, as having heard him disturbed me, and did not trust him to give a bath to Exxxx alone.

When I heard Dave say that a second time, it reinforced what I already though in relation to his thoughts about little girls. During our stay in Mallorca, Dave and his wife, Fiona, accompanied by this daughter Lxxx, took Madeleine (page 6) with them to spend the day together, and to give Kate and Gerry a bit of rest and time to be with the twins. When I say this, it is not that I was worried with Madeleine's safety, since she was also with Fiona and Lxxx, and also with Dave, as far as I know.

As I already referred, I was only with Dave and Fiona on one occasion, after Mallorca, and I have not spoken to them since that time. In the last two years, we have met, as a family, with the McCANNS, once in a while. That happens mainly at the children's birthday, a time when we get together.

The first time I had knowledge of the terrible news about Madeleine's disappearance trough the radio, my thoughts went immediately to Dave. I asked Savio if Dave was also on holidays with the McCANNS in Portugal but he did not know.

I watched TV meticulously, and seeing the coverage of the news, I understood that Dave was there, because I saw him, in the background, on the television images during the first days after the Madeleine's disappearance. Based on that, I believed that he was on holidays with the McCANNS in Portugal.

Today, Wednesday, the 16th of May of 2007, at 17:40, I gave DC Brewer an A4 page containing 2 photographic images. I am going to reference these images as (ref KZG/1) (probatory element) that may (page seven) be presented as mean of proof, if necessary.

These photographs were taken during the holidays in Mallorca. In the photographs, Dave is wearing a white t-shirt and the woman in the photograph corresponds to his wife Fiona. The man who is holding the cup of wine in the photograph is Sxxxx. These photographs were taken whilst we were in Mallorca.

One night, on holidays, the adults, that is, the couples aforementioned, were in a patio outside of the house where we were staying. We had been eating and drinking.

I was seated between Dave and Gerry who I believe were both speaking about Madeleine. I don't remember the conversation in its entirety, but it seemed they were discussing a possible scenario. I remember David telling Gerry something like "she", referring to Madeleine, "would do this".

When he mentioned "this", Dave was sucking on one of his fingers, pushing it inside and outside his mouth, while with the other hand he made a circle around his nipple, with a circulatory movement over his clothes. This was done in a provocative manner and carried an explicit insinuation in relation to what he was doing and making.

I remember that I was shocked at this, and looked at Gerry, and also at Dave, to gauge their reactions. I looked around (page 4) as if saying "did someone else hear that, or was it just me". There was a nervous silence registered in all the conversations and afterwards, everyone began talking again.

I never spoke to anyone about this, but I always felt that it was very strange and it wasn't something that someone should do or say.

The Fund

I've been able look at the first year's accounts of the Madeleine Fund. For a couple of quid you can download them from Companies House.

The full title is- Madeleine's Fund: Leaving No Stone Unturned Limited.

Company Number: 06248215

The accounts were ruled off at the end of March last year. Then the fund had a surplus of just over 1 million pounds-£1,052,027.00 to be exact. It's not clear from the accounts, but I suspect that figure might well include the damages paid by the Express Group to the McCanns as the result of their libel settlement. The total fund income from the date it was established was £1,846,178.00. In other words in the first year the directors have authorised nearly a million pound of expenditure. That includes the fruitless payment to Metodo 3, the Spanish private investigators, who made absolutely no progress.

Page 2 of the accounts, The Director's Report , dated 11th November 2008, and signed by John J McCann, contained this

" As expected, the level of donations [to the fund] has fallen over time, although we have a number of loyal donors continuing their support. Income in the new financial year is currently significantly lower than at the same time last year. However our expenses are ongoing are likely to increase."

And this report suggests that the financial situation is now perhaps more difficult than in November 2008.

The next accounts will be filed in about ten months time.

It will be interesting to see just how challenging the financial situation will be then. I suspect that unlike between March 2007 and 2008, they will not contain these items.

Maybe because a "sob" story about a missing toddler is more interesting - I don't know.

In the Sunday Express recently an Investigative Journalist, Donald McIntyre, "proved" in his article that the "abductor" was hiding in the apartment when Gerry went to look at the children. Apparently hiding behind a door that opened against a flat wall or wardrobe! He dismissed every other piece of evidence and brought in a daft theory that no one else has considered.

Somehow the Mccanns have managed to stop the British Press from printing this. However, it is in Amarals book. Very clear why at all costs to the Mccanns this book had to be stopped.

From everything that is exposed, the process files result in the following:

A) the minor Madeleine McCann died in apartment 5A at the Ocean Club resort in Praia da Luz, on the night of the 3rd of May 2007;

B) a simulation of an abduction took place;

C) in order to render the child’s death impossible before 22H00, a situation of checking of the McCann couple’s children while they slept was made up;

D) Kate McCann and Gerald McCann are involved in the concealment of the cadaver of their daughter, Madeleine McCann;

E) at this moment, there seem to be no strong indications that the child’s death was not the result of a tragic accident, yet;

F) from what has been established up to now, everything indicates that the McCann couple, in self-defence, doesn’t want to deliver the cadaver immediately and voluntarily, and there is a strong possibility that it was moved from the initial place of deposition. This situation may raise questions concerning the circumstances in which the death of the child took place.

Therefore, we suggest that the case files are sent to the Republic’s Prosecutor, in the Lagos legal district, for:

I am a little pushed for time at the moment, so if I have to leave will continue later with the explanation. Tony Bennet is a lawyer. Debbie is the daughter of a Police Officer. They had a forum that was for ALL neglected children. Tony ,at the beginning of this case, tried to take the Mccanns along with many signatures from the public, who were angry that the Mccanns had left three toddlers alone in an unlocked apartment to court for neglect. For some unknown reason the case was thrown out. I shall send you a link. Tony about a year ago produced a leaflet ,,,30 reasons why Madeleine could not have been abducted. Tony sent this leaflet to the Mccanns, Clarence Mitchel and Carter Ruck. He asked them if there was anything in this leaflet that they objected to. He received no response. A couple of months ago Debbie along with Grenville Green ( A well known supporter to many of us) along with his wife posted the leaflets in Rothley. This was televised and Debbie was interviewed. (Will send link).
A couple of people from Rothley were also interviewed about the leaflet. Finally we had some reporting on the possible accidental death of Madeleine.
The Mccanns through their lawyers threatened The MF Forum with legal action if they did not remove their site. Tony and Debbie tried but were warned they would lose everything if they continued down this road. They had no option they could not afford to go against the Mccanns so closed the site. There is now a new site that I have posted which has nothing to do with The Madeleine Foundation. Stevo is now running the site from the States . Stevo has also written abbok called "The Faked Abduction" soon to be published.

Tony and Debbie have been ordered to hand over all leaflets to Carter Ruck.

Tony takes action for Neglect

Reason 1: Statistics show that the vast majority of young children reported abducted from their homes are already dead

Time after time, when young children die or are killed in their own homes, parents claim their child has really been abducted. The death may be from an accident, negligence, neglect or deliberate act. We can simply say: young children are almost never kidnapped from inside their own homes. The Portuguese police were bound to be suspicious of the parents' claims that Madeleine had been abducted. But these statistics, though very persuasive, do not prove anything. So let us look at nine other reasons which suggest that she was not abducted.

Reason 2: The world-renowned British sniffer dogs, Eddie and Keela, detected the scent of a corpse in 10 places which strongly suggested Madeleine died in the McCanns' holiday apartment

Here are the main facts about the findings of the two British springer spaniels, Eddie and Keela:

* they were trained by expert dog-handler Martin Grime and are internationally famed for being able to detect the presence of a corpse (Eddie) or blood (Keela)

* Grime said that Eddie had never ever given a 'false alert' in 200 previous outings

* Eddie alerts only to human cadaverine - the scent of a human corpse. This is usually only produced in a corpse when the body has been dead for over 2 hours

* Eddie alerted to the scent of a corpse in the following places: the living room, the McCanns' bedroom, the veranda and the garden of their holiday apartment, on two of Dr Kate McCann's clothes, on a T-shirt belonging to Madeleine or brother Sean, and on the pink soft toy, 'Cuddle Cat' (despite the fact that Dr Kate McCann had already washed Cuddle Cat at least once)

* Eddie also detected the smell of death in the McCanns' hired Renault Scenic car

* Keela found blood at some of the same locations

* Eddie and Keela were taken to many other apartments and cars in Praia da Luz, but did not alert anywhere else

* checks were made by the Portuguese police as to whether anyone else had died in the McCanns' apartment or in their car. No-one had

* a neighbour made a witness statement saying that for weeks she saw the McCanns' hired car with its boot open all night long.

Reason 7: The McCanns' rush to appoint lawyers and PR experts

Immediately Madeleine was reported missing, the McCanns appointed many lawyers and public relations experts to help them, including extradition lawyers. What use would lawyers and PR experts be in finding their daughter? Maybe the McCanns knew from the outset that they would need lawyers and PR folk to defend them?

Reason 8: The strange reactions of the McCanns and their friends after she claimed to have found Madeleine missing

What is one to make of these reactions of Dr Kate McCann on finding Madeleine missing and stating she noticed the shutter and window open?

* she searched the apartment 'for 10 minutes', despite on her own evidence the probability that she was not there

* she left the twins in her apartment whilst she ran to the 'Tapas Bar' to raise the alarm

* she failed to check on the twins' well-being. The first thought through most mothers' minds would have been whether they could also have been interfered with.

In addition:

* in the days after Madeleine went missing, the McCanns were apparently happy to leave the twins in the crèche whilst they courted the media. If they were genuinely distraught by losing one child, would they not stay protectively close to the two they had left?

* the McCanns admit they never physically searched for Madeleine

* despite the claim of Jane Tanner that she had seen a man walking with a child in a certain direction, the McCanns and their friends failed to organise a concerted search in along the route he might have taken.

From the early days, the McCanns made plans for events to mark the day Madeleine went missing - a sign they didn't expect to find her:

* just a month after she 'disappeared', Dr Gerald McCann said: "We want a big event to raise awareness that she is still missing. It won't be a one-year anniversary, it will be sooner than that"

* then, on 28 June 2007, he said: "I have no doubt we will be able to sustain a high profile for Madeleine's disappearance in the long-term"

* the McCanns trade-marked the name 'Madeleine's Fund' and highlighted Madeleine's eye defect - the coloboma - boasting that her eye defect was 'a valuable marketing ploy'. Why make long-term plans if Madeleine could be found at any time? Strangely, Madeleine's eye defect doesn't figure in 'Missing Person' descriptions of her on the Portuguese police or Interpol websites. In March 2009, before a Parliamentary Committee, Dr McCann claimed British media made Madeleine 'a commodity'. Yet just a fortnight after Madeleine went missing, he and his advisors set up a website, a private company to raise money (note: not a charity), and produced goods for sale.

Reason 10: Dr Kate McCann washing the toy 'Cuddle Cat'

The McCanns claimed Madeleine always took her favourite soft toy, 'Cuddle Cat', with her. They then said the abductor had handled 'Cuddle Cat', placing it on 'a high shelf or ledge'. The abductor could have left valuable forensic traces on the toy. So why did Dr Kate McCann decide to thoroughly wash it, something most mothers say they could never do to the soft toy of their missing child. Later, despite Dr Kate McCann washing Cuddle Cat, cadaver dog Eddie detected the smell of death on it. The smell of death remains on items long after they have been thoroughly cleaned.

WHAT YOU CAN DO NOW

Marcos Aragão Correia, the lawyer who represented Leonor Cipriano in the process in which Gonçalo Amaral was condemned – to a suspended sentence of one year and three months in prison over false deposition -, interrupted the former Polícia Judiciária coordinator’s birthday party, at around midnight yesterday, in the company of a PSP patrol, in order to identify the authors of an alleged aggression attempt that would have taken place only minutes earlier, at the restaurant’s door.

Our source at the scene told us :«After dinner, just outside of the restaurant, there was a huge cake, dessert and champagne. The Mayor of Portimão, Manuel da Luz, and a few members of his staff joined the party. At 11.30, there was fireworks, "Happy Birthday" was sung and champagne bottles were popped.

And then, shortly after the fireworks, a car approached and parked opposite to the restaurant's entrance, where the party was in full gear. Inside the car, looking ostensibly at the party, there was Marcos Aragão Correia. He made sure that his presence was noticed, then he drove away.»

Marcos Aragão Correia at that time made an obscene gesture to the guests, who were on the street to make a toast after the fireworks. The lawyer was sitting in a car, with two other occupants, parked in front of the restaurant where the party took place, in Portimão’s riverfront area. A witness – who was identified by the PSP – admitted to having threatened the lawyer after seeing him make the obscene gesture. After the threat, the lawyer, who was driving the vehicle, took off in a hurry with the tires screeching, and returned, minutes later, accompanied by a PSP patrol.

Our source at the scene said :«There was police all over the place (PSP, Public Security Police) because Marcos Aragão Correia had called in the police, stating that he had been aggressed by a few party guests. The whole scene was witnessed by dozens and dozens of people, including the Correio da Manhã reporter and the Mayor. Marcos Aragão Correia had obviously NOT been aggressed, that much was clear, and things were soon clarified with the PSP agents, who left the scene a quarter of an hour later.»

When Gonçalo Amaral and Paulo Pereira Cristóvão (co-accused acquitted in the case of Leonor Cipriano) approached the PSP agents in the middle of the street, Aragão Correia fled running. The CM attempted to contact him yesterday, but he had the mobile phone disconnected.

Madrid, 6 oct (EFE) – The parents of Madeleine McCann, Gerry and Kate, may return to the Portuguese village of Praia da Luz, where their daughter disappeared from, before the end of the year.

Thus said today the father of the little girl that disappeared in May 2007 while the family enjoyed their holiday at said village in the Portuguese Algarve.

“Kate would like to return to Praia da Luz when things are less intense, but we’d like it to be a private visit, probably before the end of the year”, said Gerry McCann.

McCann intervened in the international lawyers’ congress, which is held at the Municipal Conventions’ Palace in Madrid, as a lecturer on a panel about the media and the right to privacy and to reputation.

In a statement after his participation, McCann asserted that, although there was no advancement in the investigation, there is also “absolutely no indication that she suffered any hurt or harm, therefore we must believe that she is alive out there and we cannot stop looking for her”.

“As parents, it is our obligation to continue searching for her; we must convince people that the searches must continue, and we should return to Portugal”, he said.

The McCann couple was in Portugal in late September, in order to reactivate the search for their daughter.

Speaking in front of an image of his daughter just like she was when she disappeared, and a computer-generated one of how she might look almost three years later, McCann underlined that “only because she disappeared over 2 and a half years ago, people should not forget about Madeleine or about the search for her.”

Just as television investigator Donal MacIntyre suggested in this paper three weeks ago, they believe there was a dry run prior to the kidnap that fateful night at apartment 5a of the Ocean Club resort in Praia da Luz.

While checking the layout of the apartment the night before, the kidnapper probably woke Sean, who in turn woke Madeleine. In the morning she had told Kate and Gerry she was frightened.

The fact that the children woke up is thought to have persuaded the kidnapper to use knock-out drugs when he returned the next night to take Madeleine, three.

On the question of the duplicate key, holidaymakers often left front door keys under the doormats during the day.

A theory emerging is that the kidnapper had a duplicate key to apartment 5a, which could have been used on the night to enter by the front door.

Mr Edgar and Mr Cowley do not believe Madeleine was taken through an open window as it would have been awkward, time consuming and there were no forensic clues left behind.

It is far more likely, they say, that he simply walked out of the front door with her in his arms. It had been thought that the front door was double locked, making it impossible to open from the inside, but this doubt falls away if there was a duplicate key.

The theory suggests the ­kidnapper had been targeting the apartment for a long time and had a detailed knowledge of the lock system.





With the front door unlocked, it is easy to simply pull a latch across to open it from the inside.

Another possibility is that the front door was not double-locked when Kate and Gerry left through the unlocked patio doors to join their seven friends at the resort’s tapas bar some 30 metres from their apartment.

Meanwhile it emerged yesterday that the parents of a two-year-old girl who has gone missing in New Zealand are being ­supported by the ­McCanns.

Aisling Symes vanished from a relative’s house in an Auckland suburb on Monday.

Her mother Angela had been close by, standing beside a washing machine.

There have been reports that the girl was later seen with a woman of Asian appearance.

Detectives believe she was ­abducted. Despite repeated ­appeals for help their searches have so far drawn a blank.

Kate and Gerry McCann said their “thoughts and prayers” were with the family.

The little girl’s father, Allan Symes, who is originally from County Waterford in Ireland, made an emotional plea for her return, saying: “These recent days have proven to be the most harrowing of our lives; no sleep and we feel like we’re barely ­existing, just surviving every ­moment, not knowing where ­Aisling is.”

It has also emerged that police in Sweden are trying to find a girl said to bear a resemblance to Madeleine after a photograph was posted on a website.

However, she does not appear to have the distinctive mark Madeleine has in her right eye.

The kidnapper of Madeleine McCann drugged her and her twin brother and sister so they would all be quiet while she was snatched.

A duplicate key may also have been used to gain entrance to the holiday apartment where the children were sleeping, say investigators.

It means the monster is still a threat to children living or holidaying on Portugal’s Algarve and must be caught urgently as he is highly likely to reoffend.






Former police detectives David Edgar and Arthur Cowley have spent months re-analysing every shred of evidence.

They are convinced the ­abductor went to the family’s apartment on May 3 2007 fully prepared with sufficient drugs, probably ­chloroform, to knock out all three children.

The fact that Sean and Amelie, then just 18 months old, failed to wake when the alarm was raised, nor even as they were taken to another apartment in the cold night air, has persuaded the detectives that they, too, must have been drugged.

Had the twins been tested for drugs immediately, any ­medication used could have been established, making it easier to identify the kidnapper, but vital time was lost.

Chloroform can be made ­easily and other sedatives, such as the horse tranquilliser ketamine, are commonly in circulation in the criminal underworld.

Even now, however, experts say there may be forensic clues on clothing or bedding which could yield a breakthrough.

The Sunday Express can further reveal that the McCanns’ private detectives are working on a solid theory about exactly how Madeleine was abducted.

SUNDAY EXPRESS COMMENTARY

IT IS both a scandal and a crying shame that almost two and a half years after Madeleine McCann went missing the forces of law and order have failed to solve the mystery, bring her kidnapper to justice and find her.

Portuguese detectives working closely with Leicestershire Police and with limited support from Scotland Yard have amassed bulging case files but precious little hard evidence or, more importantly, any suspects.

The Portuguese investigation has effectively been shelved, with senior officers saying it will only be reopened if they receive credible new information.

So now finding Madeleine has become the responsibility of two retired middle-ranking police detectives working as private investigators for Kate and Gerry McCann.

While David Edgar and Arthur Cowley have done a solid, credible job so far, Home Secretary Alan Johnson should now ask Scotland Yard to set up a cold case review team to follow through on the pair’s fresh leads and work closely with their Portuguese counterparts.

For there is still so much work to be done. As a matter of urgency all forensic material, including Madeleine’s blanket and bedding, must be re-examined as the culprit must have left a trace of a knock out drug.

Scotland Yard must demand spy satellite images of the resort as the kidnapper is probably on film casing the apartment in the days, weeks and months before the kidnap. There must also be a proper, systematic search of all the scrubland in and around Praia da Luz as it is likely the kidnapper hid in the undergrowth for several hours after the kidnap and almost certainly left clues behind.

Mr Edgar is believed to be looking at five or so “persons of interest” but he has limited resources. That is why Scotland Yard must restore public confidence by taking over the investigation.

The public has a right to expect its government will spend whatever it takes to capture the most heinous of criminals, child abductors.

Only my opinion but I feel this is very tongue in cheek from the Express. The Mccanns have only to go to PJ and ask for the case to be reopened and they will do this. The Mccanns know this and so do the Express. The Mccanns choose not to, Why?

Amaral decided to write another book after Kate made a comment that confused him on the Winfrey show ....she said "I hope who ever she 's with they give her her blanket.

Tanner said in her first statement that she saw a man carrying what looked like a child wrapped in a pink blabket.This very first sighting was outside of the mccanns window and not at the end of the street. This later changed to child without blanket. The Pink blanket does seem to be a mystery in this case.

Will post link later in the day with regards to Tanners first sighting of "Bundleman".

The pink blanket does seem to have disappeared and yet it was in photos taken by forensic . Mccann was allowed back into the apartment on the 4th ...a fatal mistake by police..he was seen leaving with a suitcase and buckets and spades for the twins.

I think the starters were about to arrive so I thought oh, I'll go and do a check in sort of 20 minutes or so before last check. So I thought I'll go and do a check before the food arrives. So I just walked out of the restaurant, up the hill, I passed Gerry who was talking to one of his tennis friends at the time. And then after I'd past Gerry, at the top of the road I just saw somebody walking across the top of the road so I was a reasonable distance away from them, and that person was carrying a child.

Bilton: You say "a person." Male or female?

Jane Tanner: Oh a male, a male.

Bilton: And just describe that individual to us.

Jane Tanner: He was about probably 5'8 tall, he was taller than me but not 6' and so between those two. He was wearing quite a lot of clothes and that's one thing in hindsight again I think was quite odd because tourists when they're abroad, Brits abroad would always have cropped trousers or shorts or something, and he had a sort of a big heavy jacket and trousers on, and hair.. the one thing that I remember a lot is the hair. He did seem to have quite a lot of dark, reasonably-long-to-the-neck hair.

Bilton: Describe exactly what he's carrying, what you can see.

Jane Tanner: Well I could see.. I could tell it was a child, and I could see the feet and... feet and the bottom of the pyjamas, and I just thought that child's not got any shoes on because you could see the feet, and it was quite a cold night in Portugal in May it's not actually that warm, and I'd got a big jumper on, and I can remember thinking oh that parent is not a particularly good parent, they've not wrapped them up.

Bilton: And could you tell if it was a boy or a girl?

Jane Tanner: Only because the pyjamas had a pinky aspect to them so you presume a girl. It was actually quite cold.

Bilton: From your sketch he appears to be carrying the child in a sort of unusual way.

Jane Tanner: Yeah, he was carrying sort of across the body like that. I suppose in hindsight you'd probably think somebody would carry them more against the shoulder.

Bilton: And I have to ask you this. Are you absolutely sure of what you saw? It was a long time ago and it was only for a brief period?

Jane Tanner: Brief period but at the time I knew what I'd seen. I gave that information to the police and because of the pyjamas I'm absolutely convinced that is what I saw.

What an achievement from the Daily Mail. They managed to write an article without mentioning the Mccanns. The Mccanns have already likened this to the case of Madeleine. So maybe there was no need to. Have a feeling not for long though. I see that Jaycee has had her teeth fixed and looks well, for that I am glad and wish her and her family well.

People in payout over Madeleine Fund libel


A public relations expert who helped in the search for Madeleine McCann accepted a donation to charity today over a claim that she overcharged the fund set up to find the missing child.

Justine McGuinness brought libel proceedings in London's High Court over an October 2007 article in The People.

Her solicitor, Amber Melville-Brown, told Mr Justice Eady that McGuinness was the communications strategist for the Find Madeleine Fund from June to September 2007.

The newspaper story alleged that she had charged the fund £20,000 in excess of her agreed fee and that, following a discussion with Gerry McCann in the summer of 2007, she was forced to part company with the fund.

Melville-Brown said: "In fact, Ms McGuinness did not overcharge the fund and indeed bore many of the necessary expenses herself. Neither was she forced to resign.

"As initially agreed with the fund, she left in September 2007 to meet other pre-arranged commitments."

Given McGuinness's commitments to providing support and assistance to the McCanns and the fund, and in order that her hard work and professional integrity should not be questioned, she felt she had no option but to bring proceedings to ensure that the true position was recognised and that the false allegations were not republished."

Melville-Brown said MGN Limited had accepted that the allegations were incorrect and apologised.

It agreed to make a donation to an undisclosed charity of Ms McGuinness's choice.

MGN's solicitor, Holly Mason, apologised for the distress and embarrassment caused.

The source went on: "The fund's managers were completely taken aback when she lodged the claim and immediately phoned Gerry.

"He then spoke to her about it. As part of the agreement to part company he said he would not publicise details of the rift. Kate and Gerry put out a statement thanking her for all her work on the campaign.

McGuinness advised Gerry and GP Kate, 39, on their audience with the Pope.

And she encouraged cardiologist Gerry to go to Washington in July to learn about the latest techniques for tracing missing kids.

But some critics warned she was making the campaign too much of a slick PR operation. And there were new concerns when when Portuguese police made Kate an official suspect.

The source said: "The McCanns hired a campaigns expert rather than someone to defend their reputations if things went awry.

"Once the Portuguese started pointing the finger at Kate things had to change."

McGuinness disputes the amounts involved. Last night she defended the payments and said: "I parted on good terms with Kate and Gerry and I regard them as my friends.

"They made it very clear to me that they were happy with the work I did." She added: "I sincerely hope Madeleine is found and I wish the McCanns well."

McGuinness quit on September 15 and was replaced by ex-Cabinet Office aide Clarence Mitchell, 46.

Foreign Office chiefs had sent Mitchell to Portugal to advise the McCanns after Maddie vanished from a room she was sharing with two-year-old brother Sean and his twin sister Amelie in the resort of Praia da Luz in May.

But the McCann family was split over his switch to join the Find Madeleine campaign.

The source told The People: "Gerry was the only one who wanted Clarence.

"He was determined to get him after building a strong relationship with him in Portugal. But nobody else wanted him because he had given Kate and Gerry - what some of the family thought of as - questionable advice.

"Clarence advised Kate to take the twins swimming and get pictured in her bathing suit shortly after the search for Madeleine had captured the media's attention. Kate was horrified by the suggestion - but Gerry wanted to go along with Clarence's advice.

"It was only when other family members told Gerry it was the wrong thing to do he backed down.

"The feeling was it sent the wrong message if Kate was pictured lounging by the side of the pool when she is distraught about Madeleine's disappearance." The source added: "Finding Madeleine is Kate and Gerry's No1 priority.

"The Portuguese police investigation has left them numb and they know valuable time's been lost.

"Kate is distraught and spends most of her time sitting in Madeleine's room.

"If it wasn't for Sean and Amelie she would have broken down long ago."

Madeleine McCann - Who Cares?

I don't know why, but I'm still finding it impossible to get a straight answer about Madeleine McCann from Leicestershire police.

I called to ask about Madeleine and almost before I'd asked the question was being given the old brush off: "It's a Portuguese investigation, not ours."

The Portuguese authorities closed their investigation in July last year. The press officer said she hadn't heard or read about that.

Apparently, the Leicestershire force still passes on any potential leads to the dynamic Portuguese police who established precisely nothing about Madeleine's disappearance during their 15-month inquiry.

I gave it 24 hours and called back. This time I was told that all the Leicestershire cops involved in the Madeleine case were on half-term holiday. So push off.

She didn't actually say that, but it felt like she had.

Still, onwards and upwards. The last time I asked a Leicestershire press officer about Madeleine she got hysterical.

I hope that privately, at least, Madeleine's home force shows a bit more care and thought towards her family.

The British police involvement in the investigation of the disappearance of Madeleine McCann, led by Leicestershire Constabulary, continues. The Police have put considerable effort into the investigation and any new lines of enquiry will be investigated and communicated to the Portuguese authorities.

Information received in the UK that can be investigated in the UK is investigated by the Leicestershire Major Crime Team and evidence forwarded to the Portuguese in accordance with normal international protocols. Any information received in the UK that needs to be investigated abroad is forwarded to the Portuguese so that they can assess the information and either conduct inquiries in Portugal or direct other international inquiries through Interpol. Any requests for further investigation in the UK by the Portuguese will be expedited and evidence provided to them in accordance with normal international protocols.

The Government does not believe that a review into the role of British police in relation to the Portuguese inquiry into the disappearance of Madeleine McCann would serve a useful purpose.

We continue to hope that Madeleine will be found safe and well.

Club launches campaign for Benfica game

Everton has launched a campaign to reinforce the search for Madeleine McCann, the British girl that disappeared in Praia da Luz, in the Algarve, in 2007. The Liverpool club takes advantage of their trip to Portugal, to play against Benfica, in the Europe League, to recall Maddie’s disappearance.

In a press release, Everton recalls that one of the first photographs that the McCanns published, showed Maddie wearing one of the club’s t-shirts. Therefore, all of the Toffees’ fans that travel to Luz stadium will wear a shirt with the sentence: “We are still looking for you”. Six thousand t-shirts have been manufactured, half of them with the message in Portuguese.

Campaign by Everton Restricted

The campaign for Madeleine McCann that the Everton team wanted to do today at the Luz Stadium in the match against Benfica was restricted by UEFA .

The governing body of European football banned the use of allusive t-shirts by the English players and the passage of the girl's picture on the screens of the stadium. It is because of this decision that the campaign will be limited to the stands, where the fans of the English club can use t-shirts saying: "We're still looking for you."





Six thousand t-shirts were made, half written in Portuguese and the other half in English.

Maddie vanished in Praia da Luz, Algarve, in May 2007. The process of investigation was closed without proved conclusions.

The parents defend the thesis of abduction and one of the first pictures of their daughter released to the media shows Maddie wearing an Everton shirt.

The quota of Gonçalo Amaral in his unipersonal company, a third of his salary as the manager and the values delivered to that company by way of author rights or via commercial trademarking of works made by the former Judiciary Police Inspector were seized obliging the order of the process for defamation brought by the McCanns.

"This is a siege, they are trying to asphyxiate me at the desk", said the former Policeman to the CM.

The claim for damages follows the injunction that banned the book 'Maddie - The Truth of the Lie', written by Gonçalo Amaral, who led the investigation into the disappearance of Madeleine in the Algarve. The English family - Kate, Gerry and their children, including Maddie - ask for 1.2 million euros to the former coordinator. The attachment is a precautionary measure until the decision of that judicial proceeding.

António Cabrita, Gonçalo Amaral's lawyer, has already added the contestation to the the claim for damages. "What is in question here is an unconstitutional decision, to the extent that the book reflects the right of expression and freedom of opinion," said the lawyer to the CM. António Cabrita alleges in the contestation that the book "has nothing offensive to the McCann family, nor accuses them of killing their daughter." And he stresses that Amaral's conclusions in the book are the same of the archived process, of which the final report leaves open several possibilities, including murder.

Gonçalo Amaral suspects of the intention of financial asphyxiation , given the high cost of court fees in order to contest and for which legal aid was sought (see support). "I do not have a fund, a fund to finance my defense," said Gonçalo Amaral. And concludes: "Not only I am deprived of my basic right to freedom of expression but I also face constraints related to my defense."

The Justice fee to contest a claim for damages of 1.2 million euros is worth more than two thousand euros. Amaral asked for legal aid, so that the contestation could be made, although there is still no decision regarding the support.

The Publisher Guerra & Paz was also notified to hold back the royalties payable to Gonçalo Amaral. Valentim de Carvalho was also notified, because of a video based on the book, however it was not possible to confirm this information until the closure of this edition

Values

The McCann arrived at a figure of 1.2 million claiming that Amaral received 25% of author rights and that he charged for interviews. "Not true," says Amaral.

The book is being sold in 5 countries and was to be published in England when the legal action took place.

The Civil Court of Lisbon has ordered the apprehension of all the profits that were obtained through the sale of the book “Maddie, the truth about the lie”, by former PJ inspector Gonçalo Amaral, following a process that was filed by the parents of the little English girl that disappeared in the Algarve in May 2007.

According to the court order, the editors that published the book have already been notified that all profits from the cession and sale of the book will be apprehended for the eventual payment of an amount of 1,2 million euro.

The court notifications about this injunction have already been sent to Italy, Holland, Denmark, Germany, Spain, France, countries where the book has been translated and published.

Gonçalo Amaral, the inspector who led the investigation into the disappearance of Madeleine McCann, in 2007, was removed from the case after statements that he made to the media.

The investigation into the disappearance of the 3.year-old English girl, in Praia da Luz, was archived on the 21st of July 2008.

In September, under an order from the Civil Court, the book had already been removed from the shelves.

The book “Maddie, the truth about the lie” was published in July 2008, by editors Guerra & Paz, and in the two following months had 12 editions, of 10 thousand copies each.

Even more serious. Having already been notified about the preventive attachment of his funds, the signatory fears that he may be prevented from defending his reasons in court, due to the very high monetary cost that the judicial action that has been filed against him by Gerry and Kate McCann impose to him, in terms of lawyers’ expenses and millionaire judicial costs, from which, it would seem, only the impoverished are exempt.

Whereupon it follows that, at the moment, the signatory is not only deprived of his elementary right to freedom of expression, as he also faces constraints relating to his own defence, which cannot be designed but under the shadow of the expression of forbidden ideas and convictions, and in exchange for absolutely insufferable pecuniary amounts.

Thus the truth about the disappearance of Madeleine is at risk of being decided in the office. This is how we live in Portugal, as far as freedom and democracy are concerned.

At the moment that we are told that the solution to the investigation into the death of little Gregory [4 year old boy, murdered in 1984] might come out 1 from the end skirts of the Iberian peninsula, the Inspector Amaral sees the door (of the closet) closing on him.


What other relationship, you could ask me, exists between these two cases except that the victim is a child? Basically: a failure from the start. In Maddie's disappearance, shortly after a few weeks, the coordinator of the investigation was discarded: he had become a nuisance. And today, he has many troubles. What he faces is too big for him, the little Portuguese cop, and he is on the brink of being broken 2. Hotshot lawyers drag him to court. He must confront them. Just because the parents of Madeleine McCann did not accept the thesis of his book: the accidental death of the child and concealment of her body in order to make credible the kidnapping. Which we can certainly sympathize with, even if the arguments of the investigator hold solidly that line [i.e. supported by facts].

Just like they did previously with several British newspapers, now they require an amount that makes one's head spin: 1.2 million in damages and interests. To defend himself, the former police officer has applied for legal aid.

Three days ago, in a press release, Gonçalo Amaral has denounced the censorship that is being made to his book (a bestseller translated into 5 languages) and to the film adaptation that was based on it. In this text, he considers himself to be the victim of a serious attack on his freedom of expression. The court, inclusive, prohibits him from "quoting, commenting or analyzing any part of the book or of the video that defends the thesis of the death or the concealment of the body." And according to my contacts in Portugal, many were surprised to see in this way tampered a constitutional right.

We must recall here that in the absence of a complaint (the word is not entirely correct 3) by the parents of the victim, the investigation has been «archived», and by the Portuguese procedure the file has become public.

Amaral's book has been withdrawn from sale, and it seems (if my translation is correct4) that the copies in English did not had time to be spread. Thus far, it as not been banned in France. However, the debate to be held on Wednesday, October 21 at channel W9 broadcast of 'Criminal Investigations: the magazine of current affairs', has been canceled without anyone knowing why.


Having myself not able to cope with an armada of lawyers, I will not comment. But for us French, the process of opening a commercial site * The online store of Madeleine (Madeleine The Online Store) seems a bit strange. It is hard to imagine parents doing business selling search posters (£ 1.75 for 10), bracelets, or t-shirts bearing the face of their missing child (£ 7) ... This is not really in our culture.





This is probably different in Britain ...

To be quite honest, as I found sympathetic the reaction of the former police officer who wanted to proclaim "its" truth, all the commercial aspects that followed bother me 5.

Finally, it seems its all a matter of money.

2. sur la paille, literally meaning sleeping in a straw bed - i.e., being broken.

3. The McCanns as parents of the victim and as assistants to the process could have requested the investigation to be reopened. Why they never asked this, is a mystery to me.

4. This is clearly a mistake by the author, since the book version in English does not exist nor was it ever published. The pre-recorded interview with Gonçalo Amaral and the documentary based on his book 'Maddie, The Truth of the Lie' were forbidden to be broadcast at Channel W9 with an injunction or threat of injunction by Carter Ruck, the McCann lawyers.

More recently, only days ago, the former Maddie case inspector saw the Civil Court of Lisbon preventively seizing the profits from the sale of the books and the documentary, through an unipersonal firm in Amaral’s name, as a way to guarantee that there will be money to pay an eventual compensation, whose pertinence will only be evaluated in the main action.

According to information that was collected by JN, in the request for financial assistance, due to economical insufficiency, Gonçalo Amaral has declared a liquid yearly income of 39 thousand euros, presenting a family aggregate of four persons: the former investigator himself, his wife and two girls, aged 11 and five.

The author of “The truth about the lie” has no further assets in his name – he has no property and no vehicles. The only family car, a Ford Focus of 2003, is in his wife’s name, who is a technician at Portimão’s City Hall.

In a press release dated days ago, the former Judiciária coordinator stated that he fears that “the truth about the disappearance of Madeleine is at risk of being decided in the office”. And he is also afraid of “being prevented from defending his reasons in court, due to the extremely high monetary costs” of the process, concerning lawyers’ fees and “millionaire judicial costs, from which, it would seem, only the impoverished are exempt”.

For now, Gonçalo Amaral has requested Social Security to exempt him from paying the justice fee and other costs of the process; the final decision, which may also pass through an appeal with the courts, is not known yet.

Revoking of the injunction has been requested

Gonçalo Amaral asks the Civil Court of Lisbon to revoke the injunction, alleging that its amplitude impedes not only the divulgation of the contents of the book “The truth about the lie”, but also the divulgation of the terms that are part of the Maddie case investigation process, which ended up being archived. Thus it is disproportionate and unconstitutional, offending the right to freedom of expression.

The former PJ investigator stresses that he does not accuse Kate and Gerry McCann of having murdered their daughter and concealing her cadaver. And that he only defends the theory of her death in the Ocean Club apartment, in Praia da Luz, Lagos – not referring anyone’s authorship – and “suspects” posterior involvement of the parents in concealing the cadaver. He further underlines that his entire report is based on facts that have been established within the process and that even the inquiry’s prosecutors say it is “most likely” that the little girl is dead.

More: Amaral recalls that the McCanns themselves and their spokesman have already publicly admitted, in interviews, that Madeleine may be dead.

The former coordinator of the Maddie case investigation is asking the State for help in order to be able to defend himself in the lawsuit that has been filed by the parents of the child that went missing in the Algarve. He alleges economic insufficiency in order not to pay court costs.

Gonçalo Amaral has requested the Social Security’s help shortly before contesting the injunction that was presented by Kate and Gerry McCann, which aimed at removing the book “The truth about the lie”, and the documentary that is based on the same work, from the market, as well as to cease the sale of author’s rights into foreign countries, through editors Guerra e Paz. And further, to prohibit the investigator, who is now retired from the Polícia Judiciária, from continuing to publicly speak about his theory in the case of the little English girl.

Madeleine McCann’s parents demand damages in the amount of 1.2 million euros, which means that the value of the justice tax that has to be paid surpasses five thousand euros, for contestation only, and excluding other costs.

There are several books that have been published saying much the same thing as in Amarals book..in Portugal. One even has been published in English...The Mccanns have made no effort to have these books banned. None of these books reached the top 10 best sellers list. Amarals did ,it has been a great success and makes a lot of sense.If the British Press had reported the DVD PJ files and all witness statements in the newspapers as did other countries this book would be of no interest as the truth would be out there. It seems The Mccanns do not want the British public to see how they came to be suspects (Arguidos) in the disappearance of Madeleine. The Mccanns it would appear, want the public to think this is just a spiteful cop who is out to get them and the British press by not printing the Investigation are helping them to do just that. If they read Mrs Fenns statement given to PJ that Madeleine was left screaming and sobbing crying...'daddy daddy 'for more than 1 1/2 hours I think they may start to look a little deeper into the Mccanns checking of their children. The Mccanns are making sure this never happens.

Concerning routines, he mentions that on Sunday, they had breakfast, between 7.30 and 8.30am at the Ocean Club, namely in the resort’s bar a few metres away from the apartment. After the 5 pm meal, the parents bathed them, got them ready for the night, and played for a little while in the play area next to the tennis courts, still under the parents' supervision. The witness is heard as a victim, being the father of the minor. Of British nationality, he has no command of the Portuguese language, spoken or written. Thus, the interview is
done in the presence of an interpreter, Natália Carvalho Ferreira de Almeida.

When asked, he said that he had already been to Portugal in 1994. He stayed in an apartment on the outskirts of Albufeira. He has only returned to Portugal on this occasion.

The desire to get to know Portugal in 1994 was due to the fact that he plays golf and the country is known for its excellent facilities that practise. The present journey was made at the suggestion of a friend that accompanied him, DAVID PAYNE, who made a reservation at the Ocean Club, following an internet search, for the deponent, his wife and the rest of the group, in a total of nine adults and eight children, including the missing minor, Madeleine. The group was made up of people the deponent has known for five or six years.

They travelled in two separate groups, one composed of the deponent, his wife KATE and their three children, and the other one by his friend DAVID and his wife, their two children and his mother-in-law. The deponent travelled from the local airport (Leicestershire) and the other group, comprised of four adults and three children, departed from London.

The meeting point was the Ocean Club in Portugal. The deponent's group arrived there at 2.30 pm on April 28th from Faro airport on an airport mini bus. The other group arrived the same day at around 1 pm, also using a mini bus.

After checking in, the deponent and his wife, KATE HEALY, their daughter, MADELEINE, and their two year-old twins SEAN and AMELIE, were placed in apartment G5A. The apartment consisted of two beds in one bedroom, and two others in another room, in which were two cots on loan from the resort, in addition to the bathroom a kitchen.

The deponent and his wife slept in one of the bedrooms and in the other, their three children: the twins in cots and MADELEINE in a bed. The other bed remained empty.

Between April 28th, the day of arrival, and the time when MADELEINE disappeared, the deponent reports having noticed nothing unusual, except that on the morning of May 3rd, MADELEINE asked her father, GERALD, why he had not come into her bedroom when the twins were crying. The deponent had heard nothing and therefore had not gone into the room, yet he thought his daughter’s comment was strange, even because it was the first time that she made it.

Faced with this altered scenario, KATE checked that the twins were in their respective beds, unlike MADELEINE, who had disappeared. After thoroughly searching the apartment, his wife, quite scared and upset, went to the restaurant to alert the deponent and the others about the disappearance. Immediately, the group headed for the club and searched across all the facilities, swimming pool, tennis etc., as well as in the apartment, with the help of Ocean Club employees, while at the same time they contacted the authorities, that would later appear.

It is stressed that when one of the members of the group, JANE, went to her apartment to see her children, at around 9.10/9.15 pm, from behind and at a distance of about 50 metres, on the road next to the club, she saw a person carrying a child in pyjamas. JANE will be better able to clarify this situation.

Concerning Madeleine, she is described as being Caucasian, with rather white skin, aged 4 (12/05/2003) and around 90 cm tall. Slender, with shoulder length, straight, dark blond hair. At the time of her disappearance, she was wearing pyjamas with white floral-patterned trousers and a short-sleeved top, which was mainly pink in colour, with a blue and grey donkey figure on the front, with the inscription "EEYORE".

Concerning the child's personality, she was extrovert, very active, talkative, smart and relates to other children with great ease. Still, the deponent said that she would never go with a stranger.

The deponent has no suspects to mention, and finds no reason for this act. Neither he nor his wife have any enemies.

His daughter does not suffer from any illness and is not on any medication.

When questioned, the deponent authorises a reading of the data on his mobile phone, with the number 00447786986188 00447786986188.

Apart from the Kid Club, and the apartment, they only went to the beach once with Madeleine and other children and for a short time, given the fact that the weather was unstable. On the beach, they only ate an ice cream and went back to the apartment. Apart from what has been described, Madeleine and the other children went sailing on the beach, a five minute walk from the club, for an hour. This outing was organised by the resort itself and is part of an available chart. The supervision and organisation was done by the resort, therefore the deponent was not present, nor was his wife.

He never noticed any strange behaviour during these days or anything which might have led to such an outcome.

After having been shown the list of the club’s guests, he said he only knows the names of the members of the group.

He did not detect that any item has disappeared.

He has nothing else to add, and wishes the due criminal proceedings and to be indemnified over the action that he was a victim of.

While the children were at the "Kid Club," the deponent played tennis with his wife, went for walks, read and practised "jogging."

Yesterday, after the daily routine, MADELEINE and the twins were put to bed in their respective beds, and he stresses put to bed, at 7.30 pm. The deponent and his wife remained in the apartment to relax and drink a glass of wine until 8.30 pm. After checking the children, the deponent and his wife and the adults went to the "Tapas" restaurant, around 50 metres away, where they had dinner together. As usual, every half hour and considering that the restaurant was close to the apartment, the deponent or his wife went to check if the children were ok. Thus, at 9.05 pm, the deponent entered the club, using his key, the door being locked, and went to the children's bedroom and noted that the twins and Madeleine were in perfect condition. He then went to the toilet, where he remained for a few instants, left the apartment, and then crossed ways with someone with whom he had played tennis, who had a baby buggy, also a British citizen, with whom he had a brief conversation. He then returned to the restaurant. At around 9.30 pm, his friend MATT (a member of the group) went to his apartment where his own children were, and on his way he went into the deponent's apartment, going in through a sliding glass door at the side of the building, which was always unlocked. He went into the room, saw the twins and didn’t even notice if Madeleine was there, as everything was quiet, the shutters closed and the bedroom door half-open as usual. Then MATT went back to the restaurant.

At 10pm, his wife Kate went to check on the children. She went into the apartment through the door using her key and saw right away that the children’s bedroom door was completely open, the window was also open, the shutters raised and the curtains drawn open. The side door that opens into the living room, which as said earlier, was never locked, was closed.

Witness statement of Kate Marie Healy, on the 4th of May 2007, at 2.20 p.m.
Location: CID Portimão

The witness is heard as a victim, being the mother of the minor. Of British nationality, she has no command of the Portuguese language, spoken or written. Thus, the interview is done in the presence of an interpreter, Natália Carvalho Ferreira de Almeida.

The witness says she has been married to Gerald since December 1998. She had never been to Portugal before.

This trip came at the suggestion of friends, who convinced them, at the end of last year, to spend their holiday in Portugal. The witness thinks that this trip was organised by David Payne, who made the Praia da Luz Ocean Club reservation on the Internet for the witness and her husband, as well as for the rest of the group, a total of nine adults and eight children, including her daughter Madeleine. She has known some members of the group since the year 2000 and others for a year. She was a colleague of David's wife.

They travelled in two separate groups. One of the groups was composed of the witness, her husband Gerard and their three children, and the other one was composed of their friend David and his wife, the mother-in-law and their two children. The departure points, by plane, were Leicestershire and London.
After the trip, the meeting point was in Portugal, at the Ocean Club, where the witness's group arrived on Saturday April 28th at around 3pm from Faro airport in an airport mini bus. The other group arrived on the same day, late morning.

After checking in, the witness and her family were placed in apartment G5A. The nuclear family comprises the witness, her husband Gerard, her daughter Madeleine and twins Sean and Amelie, aged two. The apartment has two beds in one bedroom, and two in another one, plus two cots on loan from the Ocean Club, as well as a bathroom and a kitchen.

The witness and her husband slept in one bedroom and the three children in the other. The twins slept in cots, Madeleine in a normal bed, the other bed remained empty.

Between the day of the arrival, April 28th, and the time at which the disappearance was discovered, the witness says that she noticed nothing unusual. She reports only one episode where, on the morning of Thursday the 3rd, Madeleine asked the witness why she had not come to look in the bedroom when the twins were crying. The witness states that she had heard nothing and had therefore not gone into the bedroom, nevertheless she found her daughter’s comment strange because it was the first time she had made it.

As far as the routines are concerned, the witness refers that on Sunday they went for breakfast at around 7.30/8.30 at the Ocean Club, namely at the resort’s bar which is located at some metres’ distance from the apartment. On the following days, and because the bar was quite far away, they started buying food at the “BATISTA” supermarket, which is located on the same road as the apartment, and they had their first meal of the day at the apartment.

After breakfast, at around 9/9.30am, the children stayed at the resort’s childcare centre, called the "Kid Club", where they did various activities such as painting, collage etc. They stayed there until around 12.30, constantly supervised by several Ocean Club employees in a ratio of one for each three children. The witness stresses that within the crèche, due to the difference in ages, the twins were in one group and Madeleine in another, with separate activities.

At 12.30pm, they collected their children and had lunch in their apartment, as it had a kitchen. After lunch, at around 1.30pm, the children spent time near the club's swimming pool, supervised by the parents, for about 45 minutes, where they played, applied sun cream etc. After this time, they placed the children back at the "Kids Club" until around 5/5.30pm, the time when the children ate at a bar under the watchful eyes of the parents. After the 5pm dinner, they bathed the children, prepared them for the night and let them play for a while at a playground next to the tennis courts, still and always under parental supervision. At around 8pm, the children were put to bed until the following morning, when the described routine started all over again.

Later, the witness would learn that a member of the group, Russell's partner Jane, at around 9.15pm, when she went to her own apartment to check on her children, saw from behind and at a distance of about 50 metres, on the road along the club, a long-haired person, she thinks wearing jeans, with a child in his arms, walking very quickly. But she is better able to tell about that herself.

Concerning Madeleine, she is Caucasian, with quite white skin, aged four (12/05/2003) about 90cm tall. Of slim build, dark blond hair, straight and of shoulder length. Left eye blue-green, right eye also green with a brown spot on the pupil. She had a small brown spot on the skin of her left leg, as well as a small sunburn on her right forearm. She had no scars. At the time of her disappearance, she was wearing pyjamas, with white bottoms with a floral pattern and a frill at the end. The short-sleeved top, mainly pink with a blue-grey donkey figure on the front, bearing the inscription "EEYORE", an inscription which was also on one of the trouser legs.

The pyjamas are of the "Marks and Spencer" brand.

She has no suspects to indicate, nor does she find a motive for such action, as she has no enemies, and knows none for her husband.

At around 9.30pm, at the time when the witness should have gone to see her children, her friend Matt (a member of the group), who was coming to check, as well, went to the apartment where his children were staying and on his way went to the witness’s apartment. He entered the apartment through a glass sliding door at the side that was always unlocked and once inside, he had not gone into the children's bedroom. He remained at the bedroom door, listening for noise and observing the beds. He went back to the restaurant and said that everything was fine.

At around 10pm, the witness came to check on the children. She went into the apartment by the side door, which was closed, but unlocked, as already said, and immediately noticed that the door to her children's bedroom was completely open, the window was also open, the shutters raised and the curtains open, while she was certain of having closed them all as she always did.

Faced with this altered situation, she verified that the twins were in their beds, unlike Madeleine, who had disappeared. The cover was neatly pulled back and the toys were on the pillow as usual. After searching the whole apartment thoroughly, and already quite scared and unnerved, she returned to the restaurant, and alerted her husband and the rest of the group to the disappearance. The group immediately headed to the club, and set about searching in all the buildings, swimming pool, tennis courts etc... as well as in the apartment with the help of employees. At the same time, they contacted the authorities, which would later arrive.

They arrived there at around 3.45pm and came back around 6.15pm to go to the tennis courts where they stayed until 7pm. Then the interviewee went to her apartment with her children and her mother. In the apartment, her mother, helped by her husband, gave the children a bath while the interviewee went jogging on the beach until 8pm. Then she returned to the apartment and did a few household chores and went out at around 8.45pm, accompanied by her mother and her husband to go to the "Tapas," restaurant to join the rest of the group. Also note that in the statement of Fiona Payne...Jane Tanner only saw a child in a mans arms she did not know if it was Madeleine...very different to what Tanner said in the program Panorama.

The Creche closed at 10 pm...many fathers and mothers were seen coming from the creche collecting their children. There would have been nothing unusual at this time of the evening to see a child in a mans arms.

Rachel Oldfields Testimony..Again for me a Red Flag..Rachel says in her statement she would think it IMPOSSIBLE for a stranger to take madeleine without her shouting and screaming..Rachel also says that Kate came back to the table and said Madeleine Was missing...Not Abducted...She goes on to say that they went to look and see if she was hiding somewhere...

The Question being how did Kate know that Madeleine had been 'abducted'...In her interviews she always used the excuse "I cannot tell you how I know because of the Investigation"..It seems she did not let her friend Rachel know either.

Being a British citizen and not understanding the Portuguese language, in spoken or written form, the undersigned was accompanied by a sworn translator: Filipa M.C.S. The interview begins at 7.20pm on May 4th 2007.

Since last Saturday, April 28th 2007, she has been on holiday in Portugal at the Ocean Club tourist complex in Praia da Luz, accompanied by her husband Matthew Oldfield. They traveled from London to Faro airport with their daughter ******, aged 19 months. This trip was organised for a group of nine adults and eight children. Her husband and her daughter are part of the group:

* The couple, Russell O'Brien and Jane Michelle Tanner, with their daughters, **** aged three and a half and **** aged 19 months.
* David and Fiona Payne with their daughters *** aged three years and ***** aged 12 months.
* Gerald (Gerry) McCann and Kate MCann with their twins, Sean and Amelie, aged 26 months and Madeleine aged 4 years.


Also in their group is Diane Webster, Fiona Payne's mother.

The holiday was organised because the men in the group are all doctors apart from Fiona Payne and Kate McCann who worked together for a long time. These shared holidays are usually organised for the whole group, although for the last holiday, last September, Gerry McCann and Kate McCann did not go to Greece with the group.

The interviewee has known the couple, Gerry and Kate, since 2003. Her husband, Matthew, knew them from before. On arrival at the airport, they were transported in a, "Mark Warner," company bus. There were other people on the bus apart from the group. They were put up at the Ocean Club in Praia da Luz.

Her husband went into the main room and, "hung about," to listen for any noise from the bedroom where the children were sleeping. He didn't switch any lights on. He could see the twins in their beds. The bedroom door was half-open. It was only later that he realised this was strange. At the time, he gave no importance to the fact. The interviewee's husband came back to the restaurant and said that everything was fine, that he hadn't heard any noise. He also said that Russell O'Brien was staying with his daughter, ****, who was crying.

They had the main course and Jane went off to replace Russell so that he could come and eat. The interviewee does not know exactly when Russell arrived.

At around 10pm, Kate McCann went on her own to check her children. She came back to the restaurant in tears and told us that Madeleine had disappeared. We all got up then and went with her to see. The surrounding area was combed after having checked that Madeleine was not hiding in the apartment. The twins carried on sleeping. They didn't move.

The interviewee has nothing else to add. After reading with the interpreter, who explains to her, she goes on and signs.

The interviewee remembers that Kate said the window at the front of the apartment was open, the shutters raised. The couple had never opened the shutters during their stay.

The couples had their own, individual apartments, at the same complex, with their respective children. Since their arrival until yesterday evening, when Madeleine disappeared, the days have all been the same.

After breakfast, taken between 8 and 9 am in the Millennium restaurant, she takes her daughter to the Kids Club, about 10 minutes walk from the apartment. The other couples do exactly the same thing, with the exception of Gerry and Kate McCann who have breakfast in their apartment. The interviewee's daughter goes to a room at the Kids Club which is close to the, "TAPAS," restaurant. Madeleine goes to another room, situated near the club's reception, because she is older.

After dropping her daughter off, the interviewee had a tennis lesson between 11 and 12 o'clock. Then she went back to the Kids Club to pick up her daughter, ******, for lunch. She made ******'s lunch and then they went to Russell O'Brien or David Payne's apartment, where they all ate together. Only Gerry and Kate McCann had lunch in their apartment with the twins and Madeleine. The interviewee has the impression that the McCann family had one lunch on the beach.

All members of the group did their shopping at the only supermarket near the complex, the "Baptiste."
She never saw any suspicious attention, or ever had suspicions about anybody she came across, either in their independent activities or in the group with their children.

Her relationship with the couple, Gerry and Kate, is one of good friendship and they meet up occasionally at celebrations, weddings and birthdays.

Concerning Madeleine, she is a happy child, good natured and full of energy. She considers it impossible that a stranger could take her without her shouting or crying. She is a smart child who knows right from wrong.

TAPAS

They had the habit of going to eat every evening at the,"TAPAS," restaurant which is about 50 metres from the apartments as the crow flies but 60 or 70 metres round the building to the back entrance.

Yesterday, at around 8.45pm, like every evening, they joined the rest of the group to eat at the,"tapas," restaurant. Her husband Matthew, went to look for David Payne and Fiona Payne. At around 9pm, the couple arrived two or three minutes after Matthew. He had been to check the children's bedrooms, his own apartment where his daughter was sleeping but also that of the twins and Madeleine. He listened at both closed shutters and didn't hear any noise. He also checked to see if there was any noise in Russell O'Brien and Jane Tanner's apartment. He said that he hadn't heard any noise.

After placing their orders, at around 9.15pm, Gerry McCann went to check, only his apartment. He was held up for nearly 10 minutes because, he said, he had been chatting with Jes about tennis. Today there was a tournament which they both had to compete in. During Gerry's absence, the waiters started to bring the food. Jane was also absent to check her apartment. Gerry returned shortly after Jane.

Between the starters and the main course, at around 9.30pm, her husband Matthew Oldfield and Russell O'Brien both went to check on the children. Kate was also planning to go and see the children, but they told her it was no trouble, that they would go and check. Kate, therefore, stayed at the restaurant. Four or five minutes later the interviewee's husband came back after having checked his apartment. He also checked the one where Madeleine was. He went in through the patio door (the couple Gerry and Kate McCann left this door accessible for everyone during dinner) The said patio door gives access to the apartment's lounge where two doors open into the respective bedrooms.

She said that after the mother’s shouts, she had seen many people in the streets looking for the girl. She also refers to an episode when Gerry was speaking to a policeman and he refused to recognised the police force, saying that more agents of authority were needed to carry out the search.
When asked, she replied that on 3rd May she did not hear any noise from the McCann apartment, not even the opening of doors. She also said that before hearing the shouts she was watching television, as she often stays up late.

When questioned, she said that she never heard any arguments between the couple or with their children. She said that the family would spend much time outside of the apartment and therefore she did not notice their presence.
She said that until that night she had never spoken to the McCanns, because up until the 3rd May, she only sometimes saw them walking in the street. She never saw them with any vehicle.
She also said that she never told the McCanns that she had heard their daughter crying previously on 1st May because she thought it would just increase their suffering.

When questioned she said that she never saw any strange person or action before or after the event. She claims however, that a week previously she was the victim of an attempted robbery, which was not successful and neither was anything taken, thinking that the crying of the child could be linked to another attempted robbery in the residence.

Hi Mercedes, am having a touch of Insomnia so popped over to Joanas to collect the witness statement.
This is important as the Mccanns tried to cover this event by claiming the PJ had let this information into the public domain 'to hurt them'...but of course they changed the night. Mrs Fenn heard this child crying on tuesday 1st May...the Mccanns changed this 'Why did you not come when we were crying' to the 2nd May the night before Madeleine disappeared. Being of British nationality and in spite of living in Portugal, does not have knowledge of the Portuguese language in its oral and written form, therefore a police interpreter is present, UEVE VAN LOOCK. Thus, according to the facts noted in the files, she says that she has lived in the apartment since 2003, which is located on the upper floor, immediately above the room from which the child disappeared.

She also refers to the day of the 1st May 2007, when she was at home alone, at approximately 22.30 she heard a child cry, and that due the tone of the crying seemed to be a young child and not a baby of two years of age or younger. Apart from the crying that continued for approximately one hour and fifteen minutes, and which got louder and more expressive, the child shouted “Daddy, Daddy”, the witness had no doubt that the noise came from the floor below. At about 23.45, an hour and fifteen minutes after the crying began, she heard the parents arrive, she did not see them, but she heard the patio doors open, she was quite worried as the crying had gone on for more than an hour and had gradually got worse.

When questioned, she said that she did not know the cause of the crying, perhaps a nightmare or another destabilising factor.
As soon as the parents entered the child stopped crying.
That night she contacted a friend called EDNA GLYN, who also lives in Praia da Luz, after 23.00, telling her about the situation, who was not surprised at the child’s crying.
She did not have anything to report for the 2nd May, because she was only home at night.
On the 3rd May she received a visit from her niece Carole during the morning, who said that when she was on her terrace she saw a male individual looking into the McCann’s apartment, a situation which has been told to the police, her cousin even made a photo fit.
During the day nothing unusual happened, until almost 22.30 when, being alone again, she heard the hysterical shouts from a female person, calling out “we have let her down” which she repeated several times, quite upset. Mrs Fenn then saw that it was the mother of little Madeleine who was shouting furiously. Upon leaning over the terrace, after having seen the mother, Mrs Fenn asked the father, Gerry, what was happening to which he replied that a small girl had been abducted. When asked, she replied that she did not leave her apartment, just spoke to Gerry from her balcony, which had a view over the terrace of the floor below. She found it strange that Gerry when said that a girl had been abducted, he did not mention that it was his daughter and that he did not mention any other scenarios. At that moment she offered Gerry help, saying that he could use her phone to contact the authorities, to which he replied that this had already been done. It was just after 22.30.

American book about Maddie's disappearance defends Gonçalo Amaral's theory

The theory that Madeleine McCann was not abducted will again be printed on the pages of a book, this time authored by Brian Johnson. Written in English, “Faked Abduction” defends that the abduction theory was built to conceal what the book alleges to be the truth about what happened to Madeleine. The publishing is programmed for the internet and for the North American market before Christmas and is a response to the prohibition of Gonçalo Amaral’s book, “Madeleine, The Truth About The Lie”

In a statement to SIC, one of the persons responsible for the book’s publication and the author of the truthformadeleine.com website stated that he had been in negotiations with the former PJ inspector to publish the book on North American soil. “The negotiations were cancelled after the Portuguese judge’s decision, so we decided to write a book in English, which is factual and non speculative”, defended the person known as Stevo.

According to the same source, the title “Faked Abduction is the conclusion of deep investigative work. The document also includes countless excerpts from the files of the investigation that was carried out by the PJ, and is already being translated into German for possible international publication.

According to the author, the book “illustrates the various witnesses’ inconsistencies, the constant changes in the versions and the lack of cooperation from the McCanns and their friends, known as the Tapas 7, with the police”. “The McCanns have tried to prevent people from publishing the truth about the case (…) after reading the book, you decide for yourselves if this was a Faked Abduction or not”, says Brian Johnson in the text that introduces “Faked Abduction”.

Kate and Gerry McCann’s spokesperson stated that he had no knowledge about the book, yet asserted that any attempt to defame will face justice.

Apart from the legal threats, that are now starting to materialise as lawsuits, it seems evident that Amaral’s steps are under tight scrutiny. As recently as this week, the McCanns’ lawyers managed to prevent a French television channel from broadcasting the documentary about the ‘Maddie case’ that was produced by Valentim de Carvalho, as well as an interview with Gonçalo Amaral.

The argument was precisely the Lisbon Civil Court’s injunction.

International Enemy

Amaral bought himself the ‘war’ of a lifetime, by becoming involved, professionally at first, then from a personal point of view, with the searches to find the little girl that went missing on the 3rd of May 2007, while spending a holiday in Praia da Luz, Portimão. And it could have been no other way. Amaral was in a command post at the PJ, and his curriculum was filled with solved cases. This was just another one.

But it had a special component: it involved a couple of doctors with political connections in England. That condition almost always crossed paths with the police investigation’s data. The arrival of the English dogs in Portugal operates a turnaround in the process, opening new hypotheses to explain Madeleine’s disappearance. Amaral, who headed the investigation, became the target to shoot.

Pressures at the highest political level, at a time when the Portuguese Government needed to approve the Lisbon Treaty, counsel extreme caution in the relationship with the English.

What is for sure is that Amaral is removed from the investigation and the process ends up being archived. Singed by the events, as he leaves the PJ under circumstances that are publicly unfavourable for his image, the former coordinator embraces the case in his new civil life, insisting on the thesis that the police had followed but the court had not validated.

“The premature end to his career, did not only remove him from the case, but it also emphasized a certain obsession in trying to solve it, and that implied colliding with the McCanns head on, with the results that are known”, an investigator who knows Gonçalo Amaral tells “O Crime”.

Another investigator mentions: “I have no doubts that he is, at present, the McCanns’ strategy’s main target. They want to shut him up, fit him into a legal straight jacket. The amount of the lawsuit, 1.2 million, is a sign of that intention. Does anyone think, starting with the McCanns, that he owns assets in that amount, or anything near it?”.

How the McCanns made his life a living hell

Gonçalo Amaral never hid the doubts about the McCanns’ conduct. Elected to be their ‘international enemy’, he is now subject to legal persecution, forbidden from opening his mouth, with the book suspended and the assets seized.

Amaral could be a disciple of famous Inspector Columbo, the 70s television series’ star. Played by actor Peter Falk, Columbo was a detective with a neglected look, although methodical and with an almost obsessive dedication to the cases that he investigated.

Of course, the former Portimão PJ coordinator wears better looking suits, but he displays a vaguely distracted expression that conceals the same astuteness and attention to detail that were Columbo’s trademark.

In two and a half years, almost everything changed in the life of Gonçalo Amaral: he became disgraced at the PJ, he was grinded by the English media machine, persecuted and sued by the McCanns who demand a compensation of 1.2 million euros from him.

The reason for so many hassles is widely known: Amaral does not believe the English couple, he doubts the story that they tell about their daughter’s disappearance. And, understandably, the McCanns do not forgive him for that mistrust.

The Maddie process entered his life like a hurricane, swept his sleep away and now threatens to compromise his patrimony. It is the price to pay for having become the ‘thorn in the side’ of the McCanns. After managing, in September, to obtain approval for an injunction that suspended the sale of the book “The truth of the lie”, which reproduces aspects of the official investigation that was carried out by the PJ of Portimão, they equally managed to convince the civil court to advance towards seizing the former inspector’s personal assets.

The siege has closed in so tightly that the court went as far as determining that Amaral cannot speak about the book in Portugal, or in any other country in the world.

For now, the target was a firm that the former policeman uses to receive the money that is generated by author’s rights. Furthermore, there is the brutal compensation that is claimed by the English through the law firm that represents their interests in Portugal.

The establishing of a timeline and of the effective checking of the minors that were left alone inside the apartments, given the fact that, believing that said checking was as tight as the witnesses and the arguidos describe it, it would be, to say the least, very difficult that the conditions were reunited for the introduction of an abductor in the residence and the posterior exit of said individual, with the child, namely through a window with little space. It is added that the supposed abductor could only pass that window holding the minor in a different position (vertical) from the one that was visualized by witness JANE TANNER (horizontal).

. What happened during the time lapse between 5.30 p.m. (the time at which MADELEINE was seen for the last time by a person that differs from her parents or siblings) and the time at which the disappearance is reported by KATE HEALY (at around 10 p.m.).

Concerning the result of the diligences that were requested from the British authorities, as earlier mentioned, despite the fact that they were almost completely carried out, nothing new was added to the process and, consequentially, to the investigation.

The questioning of the holiday group merely corroborated what had already been established during the investigation, without any detail that could have been reputed as especially relevant being brought forward.

In conclusion, it results from everything that has been done, despite the efforts that were made and all investigation lines being explored, that it is not possible to obtain a solid and objective conclusion about what really happened that night, and about the present location of the missing minor.

On the other hand, it should be referred that this investigation moved itself under conditions of exceptional media exposure, with the publication of many "news" of imprecise, inexact or even false contents, which did not help, in the least, the discovery of the truth and created, many times, a climate of unusual commotion and of lack of serenity.

Therefore, as we do not envision, at the present moment, the execution of any other diligence within the process that might produce any useful result for the process, I submit it to your consideration, for you to determine whatever you may see as convenient."

Conclusion: The final report...but first remember this was after the departure of Goncalo Amaral...The investigation was taken over by Rebelo...who said after one year of investigation which included, photos of Rebelo trying to climb in and out of a small window with a blanket. That the investigation was pointing still in the same direction. Rebelo went to England and interviewed the group known as the tapas 7...They including the Mccanns were invited to return to PDL by Rebelo to carry out a reconstruction of that night. They refused...there was nothing more that could be done apart from drag them there by the hair. So, even after Rebelo took over, the Mccanns should have been made arguidos. Yet the Mccanns are only interested in bringing down Goncalo Amaral....

"Addressing now, and specifically, the question relative to the diligence known as the "reconstitution of the facts" (Article 150º of the Penal Process Code), which was not performed due to the refusal of some of the integral members of the holiday group to return to our country (as documented in the Inquiry), the same would have clarified, duly and in the location of the disappearance, the following extremely important details, amongst others:

The physical, real and effective, proximity between JANE TANNER, GERALD McCANN and JEREMY WILKINS, at the moment when the former passed them, and which coincided with the sighting of the supposed suspect, carrying a child. It results, from our understanding, as unusual that neither GERALD McCANN nor JEREMY WILKINS saw her, or the alleged abductor, despite the small dimensions of the space;

. The situation that concerns the window of the bedroom where MADELEINE slept, together with the twins, which was open, according to KATE. It would be necessary to clarify whether there was a draft, due to the fact that movement of the curtains and pressure under the bedroom door are mentioned, which would eventually be clarified through the reconstitution.

KATE McCANN will take part in a round of heart-rending TV interviews this week appealing for anyone who has knowledge of her daughter Madeleine’s kidnapping to come forward.

The 41-year-old mother has been keeping a low profile for months but has now decided that she wants to take a more active part in the effort to find her daughter, who would now be six.

Madeleine vanished from a holiday apartment in Praia da Luz on the Algarve on May 3, 2007.

Kate will join her husband Gerry for a series of face-to-face interviews with the BBC and ITV.

And in a new move they will also speak to several Portuguese TV journalists who are flying to London later this week to interview the couple.

Kate and Gerry, of the village of Rothley in Leicestershire, hope that emotional appeals broadcast in Portugal could persuade someone to come forward with vital information and have employed a Portuguese press officer to help them get their message over.

The woman press officer is also helping the couple deal with the Portuguese press over their long-running legal battle with former local police chief Goncalo Amaral, who is being pursued for £1million damages over a book he wrote about the case, which has been banned.

Last month Kate travelled to Lisbon to meet her Portuguese lawyers and also gave a brief interview to Portuguese TV, saying she cried every day for Madeleine. It was her first trip back to Portugal in two years.

Both she and Gerry intend to make a ­private visit to Praia da Luz in the coming months.

Now that the McCanns’ twins, Sean and Amelie, are at school, Kate is finding she has more time to spend on the hunt for Madeleine.

She works closely with their private investigators David Edgar and Arthur Cowley, who believe the answer to the riddle lies within a 10-mile radius of Praia da Luz.

“Kate has renewed vigour to get involved,” said a source. “She realises emotional appeals from her have a powerful effect and could provide the breakthrough in the case.

“There is a greater awareness now on getting the Portuguese media involved in all the initiatives they do.”

The findmadeleine.com website has been changed to carry a poignant internet appeal which says: “Imagine if she was your child, imagine the pain and grief, imagine if someone like you never came forward.

“If you stay quiet you are as guilty as those who took her.”

One recalls that Madeleine McCann was reported as missing by her mother, the doctor Kate McCann, at 10:00 in the evening, on Thursday, May 3 2007. Since then Maddie has become the world's most famous missing child. Her parents which, as the investigation revealed, presented at the best case scenario evidences of great negligence, claimed that she was abducted by a man, whose trace was never found, while they dined with friends in a restaurant about fifty meters away from their holiday apartment in Praia da Luz on the Algarve coast.

The Portuguese police have always believed in parental involvement in Maddie's disappearance. They were officially considered as suspects from September 7, 2007 to July 2008. On that date, following troubling and intense diplomatic actions of the British government, the Portuguese Minister of Justice stated that, because of insufficient evidence, no one could be held responsible for Madeleine's disappearance. The "spokesman" for the McCanns, a veteran public relations who headed the "Media Monitoring Unit [MMU/COI] formed by 40 people (!)", was placed at their disposal under enigmatic circumstances, he has repeatedly stated that «they have been cleared of all suspicion».

In October 2007, Gonçalo Amaral, the Portuguese officer in charge of the investigation, was officially removed from it, following his revelations about the pressures exerted by the English government. Some years earlier he had solved a similar case, the alleged disappearance of the child Joana Cipriano in which the mother and the child's uncle were eventually convicted for her murder. Since then, Amaral has written a book ("The truth of the Lie") disclosing the case in which he states that Madeleine died in Praia da Luz. A thesis later taken to the screen in a gripping documentary visible in YouTube.

Why does an innocent parent refuse to cooperate with the police?

The news, at times, have startling overlaps, for example, the one of the new twist concerning the old murder case of Grégory Villemin, motivated by the discovery of two DNA traces sealed in a police storeroom, with the unexpected return of the media focus on Madeleine McCann's mysterious disappearance case in Portugal, May 2007.

The famous British law firm Carter Ruck, which on behalf of its clients, has become a global specialist in silencing the media, those who in their view manifest defamatory tendencies, has in fact, sent secretly, in early September to the Madeleine Foundation's directors, created during the disappearance of the eldest daughter of the McCann couple, one of its fearful warnings.

Carter Ruck (recently dubbed «Carter Fuck» by Guardian journalists denouncing an imposed censorship) ordered the closing of MadeleineFoundation.org, the delivery of all the copies of a booklet published by the Foundation, entitled "What really happened to Madeleine McCann? - 60 Reasons which suggest she was not abducted" and all of those copies still in stock of its simplified version, a leaflet listing only 10 of the 60 reasons.

It is true that the Foundation recently distributed thousands of copies of the leaflet in question in the mailboxes of the [United] Kingdom. True to its method and hired by Maddie's parents, Carter Ruck has set as a goal to gag all those, and they are becoming more and more numerous, who doubt the abduction thesis sold by the McCanns to the Portuguese police in order to explain the disappearance of their daughter.

Why did the McCann friends refused to make a reconstruction of Maddie's disappearance night?

What are then the 10 reasons cited by the Madeleine Foundation to support its allegations against Maddie's parents in the leaflet that has caused Carter Ruck's wrath?

Reason No. 2 is much more annoying for Kate and Gerry McCann; "Eddie" and "Keela", the two famous police dogs trained by Martin Grime, who are able to detect cadaver odour and blood respectively, made gruesome discoveries in the McCann's apartment. When questioned, their trainer said that "Eddie" had never made a mistake in his 200 previous searches. And the brave animal has detected cadaverine odour in the apartment's living room, in the parents' bedroom, on the veranda and in their apartment's garden, also in two clothes belonging to Kate McCann, on a T-shirt belonging to either Maddie or to her brother Sean, but especially in Maddie's favorite toy (her "Cuddle Cat"), in spite of the fact that it had been washed at least once by her mother. "Eddie" also reported suspicious smell in the trunk of the Renault Scenic hired by the McCanns and even on the ignition car key. "Keela", meanwhile, found blood in several places in the apartment. To verify that the dogs were not just ill-disposed against the McCanns, they were taken into several other apartments of the resort as a way of test. There were no results.

The 7th is related to the speed with which they hired top lawyers, experts and others to be responsible for their public relations.

The 8th originates in the many contradictions found between the McCanns and their friends versions about the circumstances surrounding the discovery of Madeleine's "disappearance".

Reason No. 9 is related to the subsequent conduct of Maddie's parents, especially for having registered the trademark "Madeleine's Fund" and the creation of a website, and a business enterprise responsible for the manufacture of "souvenirs"...

The 10th and final reason given on the leaflet is the most devastating for the Madeleine's mother : the fact that she washed Cuddle Cat, in spite of which "Eddie" noted the distinctive smell of death ...

Disturbed Friends

But we probably have to look elsewhere for the real reason of the recent offensive by Adam Tudor, a Carter Ruck partner, against the Madeleine Foundation and the injunction to immediately close the website. One can indeed read the copy of a detailed letter of the Foundation to the Prime Minister Gordon Brown showing a real «bombshell» : the statements of Arul Savio and Katherine Zacharias Gaspar, a couple friend of the McCanns, obtained by the British police in May 16 2007, just 13 days after the disappearance of Madeleine, but that was only communicated to Portuguese police in October 2007, after Gonçalo Amaral had been removed from the investigation.

The Gaspar couple, in effect, declared that on two occasions, first in England and then in Majorca during a holiday shared with the McCanns and the Paynes, who were present in Praia da Luz in May 2007, that they felt a great distress after having fortuitously caught conversations and obscene gestures between Maddie's father and David Payne, which left them thinking that they could maintain paedophile relations with the little girl...

In short, there could still be a tiny hope of solving the riddle of little Gregory's murder. The case of Maddie's "disappearance", is clearly just beginning...

The 3rd reason given in the leaflet refers to the strange reactions from Maddie's parents when they were made aware of the results of the dogs' discoveries. Kate McCann stated initially that the odours detected by the animals on her clothes could be explained by the fact that during the 2 weeks preceding the holiday, she had dealt with 6 cadavers in the framework of her work as a doctor (!), even going so far as to say that Maddie's toy [Cuddle Cat] was similarly impregnated because she had brought it to her workplace. After consulting her lawyers, she changed her mind to finally declare that the canine search results were simply not reliable...

The 4th reason is, according to the authors of the leaflet, the implausibility of the abduction scenario described by Maddie's parents.

The 5th, is the refusal of the McCann couple and their friends, who were present on the night of the alleged disappearence, to cooperate with the Portuguese police. In September 2007, the police made 48 questions to Kate McCann over the disappearance of her daughter, the only one she deigned to answer was: «Are you aware that by refusing to answer this questions, you harm the investigation to determine what happened to your daughter?». They have also refused to be submitted to a lie detector. The Portuguese newspaper Sol attempted to interview one of the friends of the couple present in the restaurant that night. The doctor David Payne, refused categorically to answer questions from journalists, merely to conclude enigmatically, with the most terrible effect «We have a pact. This is our matter only. It is nobody else’s business».**

The 6th refers to the continuous changes in the declarations of the McCann couple and their friends.
